MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
CITY OF BALLWIN – 300 PARK DRIVE
April 5, 2004

RECORD OF PROCEEDINGS

The meeting of the Planning and Zoning Commission was called to order by Chairman Michael Boland at 7:00 p.m.  Members in attendance were:

APPROVAL OF MINUTES

A motion was made by Mayor Jones and seconded by Commissioner Karr to approve the Minutes of the March 1, 2004 meeting.  The motion received unanimous approval by the members present.

Z04-1– Zoning Ordinance Change – Lock Drive Rezoning – City of Ballwin – 14811 Manchester Road – Mr. Thomas Aiken

Chairman Boland stated that this issue was under discussion only, and not a formal public hearing. 

City Planner Thomas Aiken addressed the Commission, stating that a phone inquiry as to the zoning of 105 Lock Drive again brought up the issue of disparity of zoning and use in this neighborhood.  Five parcels on Lock Drive (105, 106, 107, 109, and 111) are developed as single-family residential but are zoned C-1 Commercial.  All areas north of these properties are zoned single-family residential.

Mr. Aiken stated that he received a petition signed by owners of three of the five parcels on Lock Drive (#107, 109, and 111), requesting that their properties be rezoned from commercial to residential.  He confirmed that all members of the Commission received it, and that a copy will be retained in the official record.  Mr. Aiken stated that as #105 is for sale as a commercial property, he assumed they did not want to change the zoning classification.  Chairman Boland asked if Mr. Aiken had heard from the owner of #106.  Mr. Aiken stated that he had not; however, the owner was in attendance and stated that she wanted to retain the C-1 commercial zoning on her property.

Commissioner Byatt asked if there were different classifications or restrictions within the C-1 commercial zoning district.  Mr. Aiken stated that there were not, but Special Use Exception regulations apply to most uses in C-1 and provide for the Planning & Zoning Commission to do site development plan review.

Michael McCallister, son of the owner of 107 Lock Drive, stated that he would like all five of the properties to be zoned residential.

Jeff Howard, owner of 116 Lock Drive, stated his preference for residential zoning.

Commissioner Byatt asked what kind of restrictions (setbacks, lighting, etc.) would be in place if lots 105 and 106 retained their commercial zoning.  Mr. Aiken stated that if lots 107 and 109 are rezoned residential, rear property lines would have a minimum of a 25-foot landscape buffer with 100% screening. Side property lines would have a minimum of a 10-foot landscape buffer.  He stated that if all properties retain the commercial zoning, only a six-foot fence would be required between properties.

A motion was made by Commissioner Byatt and seconded by Commissioner Karr to recommend changing the zoning for three lots (#107, 109, 111) to Residential R-1 to the Board of Aldermen.  The motion received unanimous approval from the Commission members present.

A motion was made by Commissioner Erwin and seconded by Mayor Jones to adjourn the meeting.  The motion received unanimous approval.  The meeting was adjourned at 7:53 p.m.
