Jet’s Pizza has operated as a restaurant at 14940 Manchester Road since February of 2013. The CAP Plaza in which Jet’s is located operates under an approved site development plan pursuant to a Manchester Road Revitalization Overlay District approval via Ordinance 11-16 in 2011. The restaurant operates without any zoning review or approval pursuant to Ordinance 11-16 because restaurants were included as an allowed use under that ordinance. The sale of alcohol by the drink, however, does not have this same provision. Such sales must be approved through the SUE process.

Petitioner: Robert & Elizabeth Uyemura, 15270 Manchester Rd, Ballwin MO 63011

The Uyemuras propose to open a restaurant with the sale of alcoholic beverages for consumption on the premises in the former Mexican market location at 15270 Manchester Road, at the corner of Manchester and New Ballwin Roads. The restaurant use does not technically require a special use exception because restaurants are allowed by right in the C-1 district if the site was previously included in a special use exception site development plan. The sale of alcoholic beverages for on-site consumption is not subject to this same by-right approval, so the special use exception review procedure is still required.

The meeting of the Planning and Zoning Commission was called to order by Chairman Michael Wind at 7:02 p.m. Members in attendance were:

Approval of Minutes

A motion was made by Chairman Wind and seconded by Commissioner Goetz to approve the minutes of the April 6, 2015 meeting of the Planning & Zoning Commission as submitted. The motion received unanimous approval from the Commission members present.

Jet’s Pizza did not have a representative present. Chairman Wind said that he had questions for the petitioner, and since no one was present to answer them, he made a motion to table Petition SUE 15-01 until the June 1, 2015 meeting. Commissioner Goetz seconded the motion. A voice vote was taken with the follow-ing result: Aye – Wind, Weaver, Utt, Silker, Goetz, Karr. Nay – Pogue. The motion passed 6-1.

SUE 15-02 Special Use Exception

Petitioner: Robert & Elizabeth Uyemura, 15270 Manchester Rd, Ballwin MO 63011

Mr. Uyemura addressed the Commission, requesting approval for the special use exception for his quick service restaurant specializing in local food. The restaurant will be open from the morning until 7:00 p.m., Monday through Friday. Mr. Uyemura wants to sell craft beer from Broadway Brewery. He would like to hold cooking classes, and wine and beer pairings once a month. The restaurant will not have table service.

Mr. Uyemura will prepare Midwestern food using local products. He will offer meals with entrées and sides for pick-up. This will be a farm-to-table restaurant.

Chairman Wind opened the public hearing, and asked if anyone wished to speak in opposition to Petition SUE 15-02. No one came forward. Chairman Wind asked if anyone wished to speak in favor of the peti-tion. No one came forward, and Chairman Wind closed the public hearing.

Mayor Pogue noted that Mr. Uyemura was formerly the Executive Chef at YaYa’s restaurant, and also pre-pares meals for Chesterfield Montessori School. Mr. Uyemura said he taught classes at L’Ecole Culinaire. Mayor Pogue asked Mr. Uyemura if he is in agreement with the recommendations of the petition review report. Mr. Uyemura said he is.

Chairman Wind made a motion to recommend approval of Petition SUE 15-02 to the Board of Aldermen. Commissioner Goetz seconded the motion, which received unanimous approval from the commission members present.

Other Business

Chairman Wind asked City Planner Aiken if the Planning & Zoning classes are still offered at UMSL. Mr. Aiken said they are held in the fall. Chairman Wind encouraged the Commissioners to take the classes if they have the opportunity.

Chairman Wind asked about elections of chairman and secretary. City Planner Aiken said terms are up in May, so it will be on the June agenda.

Adjournment

Chairman Wind moved to adjourn the meeting. Mayor Pogue seconded the motion, which received unani-mous approval from the commission members present. The meeting was adjourned at 7:10 p.m.
