            Petitioner:  Mr. Bob Candice, 100 Holloway Rd, Ballwin MO  63011                                 

Mr. Candice is proposing to park a trailer on the rear parking lot of the commercial property at 112 Holloway Rd. The trailer will be utilized for the production of barbequed meat to be sold from his restaurant Candicci’s in the adjoining Holloway Plaza at 100 Holloway Rd.  The parking of trailers is allowed in the C-1 district by special use exception per ordinance 11-19 passed on May 23, 2011. Prior to the passage of this ordinance, the parking of trailers and commercial vehicles in the C-1 District was limited to short periods of time for purposes of loading and unloading only.

The meeting of the Planning and Zoning Commission was called to order by Chairman Weaver at 7:00 p.m.  Members in attendance were:

 Approval of Minutes

A motion was made by Mayor Pogue and seconded by Alderman Kerlagon to approve the minutes of the June 6, 2016 meeting of the Planning & Zoning Commission as submitted.  The motion received unanimous approval from the Commission members present. 

SUE 16-03(2) Special Use Exception – Trailer Parking in the C-1 District

   Candicci’s Trailer, 112 Holloway Rd, Ballwin MO  63011

   Petitioner:  Mr. Bob Candice, 100 Holloway Rd, Ballwin MO 63011

Mr. Candice addressed the Commission, requesting approval for a special use exception to park the BBQ ASAP trailer on the rear parking lot of 112 Holloway Rd, which is not on the same property as his restaurant, Candicci’s.  The trailer will be used to barbecue meat to be sold from his restaurant as well as at off-site events.

Commissioner Goetz asked Mr. Candice to confirm if the trailer will be used primarily on-site and at night.  Commissioner Goetz asked how Mr. Candice will be able to see if he’s working in the dark.  Mr. Candice said that he or his employees will start smoking the meat early while it is light out, and there is a light in the trailer.  Mr. Goetz asked how electricity is going to be supplied for the light.  Mr. Candice said the trailer is set up for a generator.   Mr. Goetz expressed his concern that the trailer is parked under a pine tree, and the heat from the vents will impact the tree.  Mr. Candice said he won’t be using the trailer that often.  Mr. Goetz said that this is something that needs to be addressed.  He added that typically, a petitioner will formulate a business plan with the City ordinances in mind and come before the Planning & Zoning Commission after having addressed any issues.  Commissioner Goetz said Mr. Candice has done the opposite.  Mr. Candice said the he was told by the individual who sold him the trailer that there wouldn’t be any issues since the previous owner had already petitioned for and been granted a special use exception.

Chairman Weaver asked Mr. Candice if he had received and read the petition review report.  Mr. Candice said yes.  Chairman Weaver said that there are two points that prevent the Planning & Zoning Commission from approving the petition.  The first is that the trailer is not located on the same property as Candicci’s; the second is the lack of screening for the trailer.  Mr. Candice pointed out that the 112 Holloway Rd. property owners had provided a letter stating that they would allow the trailer on their property.  Chairman Weaver said that is irrelevant because the ordinance states that it must be on the same property as the petitioner’s business.  The previous SUE was granted because the trailer was being parked on the same property as the owner’s business.

Commissioner Zimmerman asked if the smoker is used overnight, and if so, will someone monitor the trailer.  Mr. Candice said yes.  Commissioner Goetz asked how often someone would check it.  Mr. Candice said every hour.  Commissioner Zimmerman asked if the trailer would be locked, and if there was a security camera in place.  Mr. Candice said the trailer would be locked, and he is looking into getting a security camera.

Commissioner Silker asked about the agreement between the petitioner and the owner of 112 Holloway Rd.  Mr. Candice said the owners have no problem with the trailer being parked there.

Chairman Weaver asked if the trailer could be parked by the retaining wall behind 110 Holloway.  City Planner Aiken said that is the same property as Candicci’s, so it is possible, However, the Fire Marshall should be consulted.  Chairman Weaver suggested that Mr. Candice look into this option.

Chairman Weaver opened the public hearing, and asked if anyone wished to speak in opposition to Petition SUE 16-03(2).  No one came forward.  Chairman Weaver asked if anyone wished to speak in favor of the petition.  No one came forward, and Chairman Weaver closed the public hearing.

Alderman Kerlagon asked if the petitioner is going to pursue the option of parking the trailer behind 110 Holloway Road.  Mayor Pogue asked if the City would have to re-advertise a public hearing if that is the case.  City Planner Aiken said it would be best to do so.  He said that the petitioner should determine whether the trailer will fit and if the Fire Marshall will allow it before it is readvertised.  City Attorney Jones said it would have to be advertised again because it’s a different property.  Mr. Candice asked if this was because of the tree issue.  Mayor Pogue said it’s because the trailer is not on the same property as the business license for Candicci’s.

Mayor Pogue asked if the petitioner has considered moving the smoker unit indoors into the expanded restaurant facility.  Mr. Candice said that may be an option.

Chairman Weaver made a motion to table of Petition SUE 16-03(2) to allow the petitioner to research the feasibility of parking the trailer behind 110 Holloway. Mayor Pogue seconded the motion, which received unanimous approval from the commission members present.

Other Business

Chairman Weaver asked if there will be a meeting in September.  City Planner Aiken said yes, there is a petition for indoor storage.

Adjournment

Commissioner Goetz moved to adjourn the meeting.  Alderman Kerlagon seconded the motion, which received unanimous approval from the commission members present. The meeting was adjourned at 7:29 p.m.
