The Board of Aldermen meet on the second and fourth Mondays of each month at 7 p.m. in the Board Room of the Ballwin Government Center, 1 Government Ctr. Schedule and place subject to change. Meetings are open to the public. All citizens are urged to attend.

The Pledge of Allegiance was given.

The Minutes of the October 28, 2002 Board of Aldermen meeting were submitted for approval. A motion was made by Alderman Suozzi and seconded by Alderman Buermann to approve the Minutes. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

LEGISLATION

BILL # 3196 - AN ORDINANCE ACCEPTING THE STREETS OF JEFFERSON AND BALLPARK DRIVE FOR PUBLIC MAINTENANCE AS PROVIDED FOR IN THE CODE OF ORDINANCES OF THE CITY OF BALLWIN.

Mayor Jones said that this bill had a first reading on October 28, 2002.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann for a second reading of Bill No. 3196. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3196 was read for the second time.

City Administrator Kuntz said that when this bill was first presented to the Board, it was with the understanding that Ballwin was waiting for a final approval letter from MSD and that all issues were resolved. Instead a letter acknowledging the acceptance, an inspection needed to be conducted by MSD. That inspection was completed on November 8, 2002, however, there are deficiencies which must be corrected. MSD and Ballwin are holding bonds from the developer and there’s no doubt that everything will be addressed. At this point, all issues are not resolved because the improvements still have to be reinspected and approved. For the most part, all other issues that were on the punch list have been addressed.

BILL # 3197 - AN ORDINANCE AUTHORIZING AN AGREEMENT WITH ST. LOUIS COUNTY FOR COMPUTER-AIDED REPORT ENTRY SERVICES.

A motion was made by Alderman Robinson and seconded by Alderman Buermann for a first reading of Bill No. 3197. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3197 was read for the first time.

A motion was made by Alderman Buermann and seconded by Alderman Lembke for a second reading of Bill No. 3197. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3197 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3197 with the following results: Ayes – Buermann, Lembke, Robinson, Easter, Anderson, McDowell, Suozzi, Gatton. Nays – None. Whereupon Mayor Jones declared Bill No. 3197 approved and it became Ordinance No. 02-54.

Alderman Easter said she thinks that Red Loehr would not have wanted this building named after him. His family, however, would appreciate it. She thinks he would have preferred a golf tournament in his name. Alderman Gatton said a golf tournament could also be named after Red.

Alderman Buermann commended the Ballwin Police and Metro West Fire District for the caring service they provided last week when his mother-in-law took a severe fall. He expressed his appreciation.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann to adjourn. The motion passed unanimously and the meeting was adjourned at 7:38 p.m.

A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Attorney Lucchesi said that assuming that the Board wants to move forward with the formation of this district, a motion will be necessary to draft an ordinance to establish the district. The ordinance will follow the Resolution that the Board approved. He suggested using the 85cents per $100.00 of assessed valuation to pay for the sidewalk. The formation of an advisory board or commission would need to be included in the ordinance. An election would be held via mail of the businesses along Manchester Road.: Mayor Jones said that since the Capital Budget was discussed in the Work Session prior to this meeting, discussion of the Operating Budget will be deferred until the next meeting. by Alderman Gatton and seconded by Alderman Buermann to name the Police Department building the Donald "Red" Loehr Police and Court Center. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz requested Board direction on a recognition designation in honor of former Police Chief Donald "Red" Loehr of a roadway, Police Department building, or any other suggestions. Mayor Jones and City Administrator Kuntz expressed their preference of the Police Department facility being named the "Donald "Red" Loehr Police and Court Center". by Alderman McDowell and seconded by Alderman Robinson to wait until November 20 at 5:00 p.m. to give time to see if the three critical easements can be obtained. If not obtained, the application for the grant will not be submitted. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz said this agenda item is regarding the future direction for the Ries Road sidewalk. There was a federal grant deadline for completion of plans and approval. Because the deadline passed, the funding was stopped. Soliciting for the necessary easements for construction is still in process. 14 of the 24 have been obtained. There are 3 critical easements remaining to be acquired, but the deadline for re-application for grant funding is getting closer. It’s not recommended that a funding application be filed unless the 3 critical easements are obtained. Ballwin probably won’t install the sidewalk unless the grant is received. Attempts are being made to contact these owners. November 26 is the deadline for submission of an application. Alderman Easter said that if the easement is not obtained from Mr. Geisler, the sidewalk cannot be constructed. Mayor Jones asked if Ballwin could abandon the grant after the grant is received. City Administrator Kuntz said that abandoning the same grant twice would hurt our credibility for any future applications. by Alderman Anderson and seconded by Alderman Lembke to approve the Special Use Exception transfer. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: Mayor Jones asked if this restaurant will continue as a Blimpie’s Restaurant. The petitioner, Jugdev Bhangn, said it would continue as a Blimpie’s. by Alderman Buermann and seconded by Alderman Anderson to approve the liquor license for Clancy’s Meat Market. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: Mayor Jones asked Police Captain Wise if the Police had done an investigation regarding this request. Captain Wise said they did an investigation and the result was satisfactory. by Alderman McDowell and seconded by Alderman Easter to table this bill until the next meeting. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.
