LEGISLATION

BILL # 3170

- AN ORDINANCE APPROVING AN AMENDMENT TO A TRUST INDENTURE ENTERED INTO BY THE CITY OF BALLWIN, MISSOURI, AND COMMERCE BANK, N.A., AS TRUSTEE, IN CONNECTION WITH THE ISSUANCE BY THE CITY OF ITS $20,100,000 TAX INCREMENT REFUNDING AND IMPROVEMENT REVENUE BONDS, SERIES 2002A AND SERIES 2002B (BALLWIN TOWN CENTER REDEVELOPMENT PROJECT).

A motion was made by Alderman Robinson and seconded by Alderman Gatton for a first reading of Bill No. 3170. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3170 was read for the first time.

Alderman Easter requested that this bill has been thoroughly proofread so that another meeting will not be necessary. Laura Radcliffe, with A.G. Edwards apologized for the error and assured the Board that this has been done. She said it was necessary to call a special session to correct the error because interest rates are tied to the date. City Administrator Kuntz said he and Mayor Jones have talked with representatives of the legal and bond council. Mayor Jones said he reviewed the amendments to the trust indenture and said all is in order.

A motion was made by Alderman Easter and seconded by Alderman Suozzi for a second reading of Bill No. 3170. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3170 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3170 with the following results: Ayes – Gatton, Robinson, Suozzi, McDowell, Easter. Nays – None. Whereupon Mayor Jones declared Bill No. 3170 approved and it became Ordinance No. 02-29.

A motion was made by Alderman Gatton and seconded by Alderman Robinson to adjourn. The motion passed unanimously and the meeting was adjourned at 6:25 p.m.MC
