The Minutes of the May 14, 2001 Board of Aldermen meeting were submitted for approval.

À Alderman Huddleston said in the "Report of the Mayor", regarding Brookside Drive, 4th paragraph, should be: "Alderman Huddleston said this would not be the best time to open the access because Ballwin street repairs should be taken care of first before other street projects. If Brookside is opened to Ries Road, the other end at Manchester Road should not be closed."

Á Alderman Nichols suggested amending Citizen Comments, Mary Kay St. Onge’s statement: Delete the reference to Enigma Lounge.

 Alderman Huddleston suggest amending Page 8, Parks Committee. The vote was 4-4. Mayor Jones cast the tie breaking vote by voting in the affirmative. The motion was declared passed. And under Parks Committee, Carla Boaring should be Boring.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann to approve the Minutes as amended. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

The Minutes of the May 14, 2001 Public Health & Safety Committee meeting were submitted for approval. A motion was made by Alderman Buermann and seconded by Alderman Nichols to approve the Minutes. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

PUBLIC WORKS COMMENDATION

City Engineer Gary Kramer presented a Certificate of Commendation to Street Foreman Eric Becker for rescuing a baby and mother from the Vlasis Park Lake.

BALLWIN DAYS

Co-Chairman Frank Rogers spoke regarding the sale of Margaritas by Casa Gallardo at the Ballwin Days festival. The company wants to keep the proceeds of the alcohol sales. The Committee wants to limit Casa’s advertising: No Casa Gallardo sign or Casa uniforms by personnel in the booth; it would be restricted to napkins and cups only. The profits from food sales would go to the Marshall Faulk Foundation. The Committee agreed that committee rules would have to be complied with in order to participate in Ballwin Days. Ballwin Days has never allowed a commercial enterprise to have a food booth.

Alderman Nichols expressed his concern about hard liquor at Ballwin Days, a family oriented festival. This is not consistent with a family festival. Alderman Easter said the margaritas would probably have a lot less alcohol content than what is purchased at a restaurant or bar.

Alderman Nichols said Ballwin Days is a city-sponsored / committee event for families and residents of the City of Ballwin. He finds it difficult to support the sale of hard liquor at this event. If this commercial booth is allowed this year, then next year and in the future there will be similar requests.

Alderman Huddleston asked how the Ballwin Days committee will control the amount of sales and how much of the take would go to the Marshall Faulk Foundation? Allowing this will open the flood gates for other companies to do the same in the future.

Vince Loyal, Assistant Fire Chief – Metro West Fire District

Alderman Robinson asked if Metro West is absolutely opposed to round-abouts or wanting more input into the design? Mr. Loyal said they are not completely opposed to round-abouts, however, they have concerns about such a facility at the Kehrs Mill/Clayton location.

Mayor Jones asked Mr. Camerada if the property owners in his subdivision had looked at and considered traffic calming devices such as those now in place on Spring Meadows. Putting up a lower speed limit sign doesn’t usually solve the problem. Alderman Nichols agreed and asked that the residents consider such options. Alderman McDowell pointed out the congestion at the Manchester Road / 141 intersection and that this could be part of the problem.

Alderman Nichols was sympathetic with Mr. Thompson’s situation, however, he restated the Board’s policy to only get involved if the house is threatened. This does not seem to apply in this case. Half of the creek is most likely platted as part of his property. Alderman Easter suggested the possibility of restoring the bank with vegetation. Alderman McDowell felt that the developer created this problem. The trustees should also be responsible.

LEGISLATION

BILL # 3098

- AN ORDINANCE AMENDING CHAPTER 3, SECTION 3-52 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN, ENTITLED "CLASSES; ANNUAL FEES".

Mayor Jones stated that this Bill has been removed because of the vote taken earlier in this meeting.

Alderman McDowell asked if it is on record that the organizations that participate in Ballwin Days must be not-for-profit organizations or is this a standard set up by the committee. Alderman Nichols said this would have to be researched, however, he believes it is in writing.

BILL # 3099

- AN ORDINANCE AMENDING VARIOUS PROVISIONS OF THE CODE OF ORDINANCE OF THE CITY OF BALLWIN DEALING WITH UTILITY TRAILERS AND PROVIDING GUIDELINES FOR THE STORAGE OF THESE SPECIAL VEHICLES IN RESIDENTIAL ZONING DISTRICTS IN THE CITY OF BALLWIN.

A motion was made by Alderman Nichols and seconded by Alderman Huddleston for a first reading of Bill No. 3099. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3099 was read for the first time.

City Attorney Lucchesi said that since this ordinance changes the Zoning Ordinance, Sections 4 and 5 must go to the Planning and Zoning Commission for review. Mayor Jones said he would like to get Sections 1-3 and 6-8 voted on as soon as possible.

A motion was made by Alderman Nichols and seconded by Alderman Suozzi to amend Bill # 3099 to exclude Sections 4 and 5; draft an amendment to the Zoning Ordinance to be submitted to Planning and Zoning for Sections 4 and 5, which will later be presented to the Board as an amendment to Bill # 3099. A voice vote was taken with a affirmative result and the motion was declared passed by a 6-1 vote..

A motion was made by Alderman Huddleston and seconded by Alderman McDowell to amend the ordinance to require a hard surface for parking at any location on the lot. Mayor Jones objected to this amendment. A voice vote was taken and the motion failed by a 5-2 vote with only Aldermen Huddleston and McDowell voting favorably.

A motion was made by Alderman Suozzi and seconded by Alderman Robinson for a second reading of Bill No. 3099 as amended. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3099 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3099 with the following results: Ayes – Robinson, McDowell, Buermann, Suozzi,, Nichols, Easter. Nays – Huddleston. Whereupon Mayor Jones declared Bill No. 3099 approved and it became Ordinance No. 01-41.

BILL # 3100

- AN ORDINANCE AMENDING CHAPTER 13, SEC 13-24 ENTITLED "INSPECTION FEES" SUB PARAGRAPH (A) BY INCREASING THE FEE FOR SINGLE FAMILY HOUSING INSPECTIONS TO PARTIALLY RECOVER THE COST OF SUCH INSPECTIONS.

A motion was made by Alderman Easter and seconded by Alderman Nichols for a first reading of Bill No. 3100. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3100 was read for the first time.

A motion was made by Alderman Nichols and seconded by Alderman Buermann for a second reading of Bill No. 3100. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3100 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3100 with the following results: Ayes – Nichols, McDowell, Huddleston, Easter, Buermann, Suozzi, Robinson. Nays – None. Whereupon Mayor Jones declared Bill No. 3100 approved and it became Ordinance No. 01-42.

BILL # 3101

- AN ORDINANCE AMENDING CHAPTER 17, SECTION 17-33 OF THE CODE OF ORDINANCES IN THE CITY OF BALLWIN, ST. LOUIS COUNTY, MISSOURI BY AMENDING THE LAST SENTENCE OF SUBPARAGRAPH 8 THEREOF TO EXEMPT CERTAIN GOVERNMENT ACTIVITIES AND PUBLIC UTILITIES.

A motion was made by Alderman Buermann and seconded by Alderman Nichols for a first reading of Bill No. 3101. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3101 was read for the first time.

A motion was made by Alderman Suozzi and seconded by Alderman Buermann for a second reading of Bill No. 3101. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3101 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3101 with the following results: Ayes – Huddleston, Suozzi, Nichols, Robinson, Easter, McDowell, Buermann . Nays – None. Whereupon Mayor Jones declared Bill No. 3101 approved and it became Ordinance No. 01-43.

- AN ORDINANCE APPROVING THE VLASIS PARK CONNECTOR RIGHT OF WAY DEDICATION PLAT FOR THE NEW CONNECTOR ROADWAY IN THE CITY OF BALLWIN.

A motion was made by Alderman Nichols and seconded by Alderman Huddleston for a first reading of Bill No. 3102. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3102 was read for the first time.

The motion passed unanimously and the meeting was adjourned at 10:00 p.m.: A motion was made by Alderman Robinson and seconded by Alderman Huddleston to draft an ordinance with the changes that have been recommended as a result of State legislation dealing with toy vehicles, operator licenses, and disorderly conduct. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz announced that a meeting of this committee will be June 20 at The Pointe.: A motion was made by Alderman Robinson and seconded by Alderman Suozzi to extend the contract with Markey & Associates for the Aquatic design. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz requested Board direction regarding a city position on this issue. Alderman Huddleston said the Halls Ferry Circle is a 2-lane circle. He said it does not work well at all and there are 6 or 7 streets coming into the circle. The Board asked for more details on the design and accident frequency.: City Administrator Kuntz suggested deferring further consideration of this issue until the construction and improvements of Ries Road and Manchester are complete. Alderman Easter agreed. A motion was made by Alderman Easter and seconded by Alderman Huddleston to take no further action until after the completion of the new intersection of Ries and Manchester. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz said a motion is requested to draft legislation for discussion at the next meeting. A motion was made by Alderman Nichols and seconded by Alderman Suozzi to prepare draft legislation to be presented at the next meeting. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: City Administrator Kuntz said a bid of $51,527 from Applied Pavement Technology, Inc. was received. The initial proposal from KMS Associates for $31,500 range is recommended for approval. A motion was made by Alderman Huddleston and seconded by Alderman Robinson to award the contract to KMS Associates. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: Due to the late hour, City Administrator Kuntz suggested holding this topic over to the next meeting. The Board was in agreement.: City Administrator Kuntz said Mr. Baumann has endorsed the proposal for the consolidation sign with Seventh Inn. According to Mr. Baumann, Seventh Inn is not willing to share the sign at this time. He recommended that the Seventh Inn not be given the option of relocating its sign other than to share a sign with Seven Trails Apartments. Mayor Jones agreed. Alderman Buermann requested a sketch of the location of the signs.: City Administrator Kuntz presented a proposal for the 3-lane design. The Rockwood School District has endorsed the proposal in writing. Alderman Buermann asked if this will increase cut-through traffic on Nancy Place. City Administrator Kuntz and Alderman Nichols agreed that there could be more traffic. The next step for this will be to go to a Public Hearing. There are many real estate issues to discuss.: Mayor Jones said he would like to schedule a half day public work session, perhaps a Saturday morning. Alderman Buermann requested that Mr. Warren present the data from the Public Opinion Survey to the Board. Alderman Nichols believes that a Saturday morning is better and suggested Saturday, July 21, 8:00 a.m. – 12:00 noon. The Board was in agreement.: Mayor Jones suggested using "The St. Louis Countian" for advertisements. It’s a lot less expensive. Notices should also be posted on the website. Alderman Easter believes the signs posted for Public Hearings are too small. Alderman McDowell asked about the circulation of "The St. Louis Countian". Mayor Jones and City Attorney Lucchesi said it’s not a general circulation newspaper; most people do not receive it. City Attorney Lucchesi said in the past the Board backed off from using this newspaper after being questioned by residents as to why advertising was published in a newspaper that so few people receive. Alderman McDowell believes that the "Press Journal" reaches the most people in Ballwin, and "The St. Louis Countian" does not. Alderman Nichols said he has never seen "The St. Louis Countian". City Attorney Lucchesi said it is a legal newspaper with limited residential distribution that mostly lawyers and construction companies receive.: Mayor Jones said the census block data has been received and the ward boundary analysis can resume. Alderman Suozzi recommended the appointment of Sue Heath to the Boundary Committee. (Alderman Buermann is the Ward 2 aldermanic representative); Alderman Nichols recommended Bruce Anderson for Ward 3. (Alderman Nichols is the Ward 3 aldermanic representative); Alderman Easter recommended Ed Montgomery in Ward 1. (Alderman Easter is the Ward 1 aldermanic representative); Alderman Huddleston recommended Richard Boerner in Ward 4. (Alderman Boland is the aldermanic representative). by Alderman Nichols and seconded by Alderman Buermann to approve the Consent Items. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.: Mr. Thompson said there is a creek that is eroding his back yard. Six to nine months ago, he asked that Assistant City Engineer Bob Baxter look at it, but has received no response. Mayor Jones said creek maintenance on private property is the responsibility of the property owner. Mr. Thompson does not believe that he should have to bear the cost of restoration. He said 10 feet of common ground has been washed away.: Mrs. Kierle said she is pleased with not having open drainage if 8 foot shoulders are installed. She is opposed to the round-about, but is very happy with the middle lane.: Mr. Goetz said he likes the center-turn lane. He supports the Board’s position on the Enigma Lounge. Mr. Goetz said that preventing the undesirable circumstances inflicted on the adjacent subdivision is more beneficial to the City of Ballwin than all of its parks in the area. He also opposes the $65 house inspection fee. He suggested substituting a private inspection report for the City inspection. Mayor Jones said this would not be possible because of the need for continuity in the inspection process and issue of enforcement. Mr. Conley said there used to be a lot of accidents in front of St. Claire, but the new turn lane has dramatically reduced the accident rate. He is opposed to any medians, but would like 8-foot wide shoulders for safety and mail delivery.: Mr. Pisarkiewicz said that a round-about is not a good idea and is too confusing. He believes that there is a great problem with 2-lane round-abouts. He is concerned about the issue of high accident occurrence. He does not believe that the accidents are related to the intersection.: Mr. Deese expressed his opposition to a raised median on Clayton Road between Baxter Road and Clarkson Road. He is concerned about convenience and safety. Alderman Suozzi assured Mr. Deese that no property would be blocked for access and raised median locations are limited. A MoDOT representative said that no abutting property owner will be blocked, but medians will be built where possible.: Mr. Camerada expressed frustration with the high volume of cut-through traffic on Bitterfield. Traffic surveys were done in April, 1998. At that time, over 1,000 cars per day went through the subdivision. Another traffic survey was done on January 17, 2001. The report by Captain Baumgarth was that 5,500 cars going through the subdivision Monday – Friday. A letter from Chief Biederman on January 29, 2001 states that "there is no question that Bitterfield is being used as a cut-through between Hwy. 141 and Henry, mostly in the evenings". This means there’s one car every 20 seconds through the subdivision. During all of last year, there were only 8 traffic tickets written on Bitterfield, out of over 1,000 cars per day.: Mr. Loyal spoke regarding the traffic circle / round-about at Clayton and Kehrs Mill proposed by MoDOT. He said the Metro West Board of Directors has issues with this proposal. They have sent correspondence to MoDOT, but have had no response. by Alderman Huddleston and seconded by Alderman Nichols to deny the sale of hard liquor at the Ballwin Days festival. A voice vote was taken with 6 Ayes and Alderman Robinson abstaining. The motion was declared passed.
