MINUTES OF THE BOARD OF ALDERMEN MEETING

The meeting was called to order by Mayor Jones at 7:05 p.m.

The Pledge of Allegiance was given.

The Minutes of the December 11, 2000 Board of Aldermen meeting were submitted for approval.

A motion was made by Alderman Nichols and seconded by Alderman Buermann to approve the Minutes. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

HOLIDAY LIGHTING CONTEST

Roy Duenke presented the following awards: 1st Place: Robert and Kathleen Arf and son Greg, 70 Log Hill; 2nd Place: Joseph and Kathleen Venneman, 250 Old Ballwin Road; 3rd Place: Donald, Carol, and Kurt James, 216 Clear Meadows.

Police Vehicles

Resource Officer

Alderman Huddleston requested that Resource Officer be removed from the Consent Items for further discussion.

A motion was made

by Alderman Byatt and seconded by Alderman Boland to approve the Police Vehicles. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

REPORT OF THE MAYOR

None.

REPORT OF THE CITY ADMINISTRATOR

Resource Officer

City Administrator Kuntz said this position is proposed due to a request from the Rockwood School District. It’s an expansion of an existing program and is subject to Federal funding. The only cost to the City would be the start up cost for the recruitment, testing, and pre-employment physical. The school district would pay the difference between the grant and Ballwin’s salary costs. It’s a 3-year COPS Grant. If Federal funding is not obtained, the City would not proceed with the position. If Rockwood decided they didn’t want to continue, the officer would be used for regular patrol and for annexations previously authorized. In the summer months, the officer would be on street patrol.

A motion was made by Alderman Robinson and seconded by Alderman Easter to give Mr. Kuntz authority to proceed with the Grant application process. A voice vote was taken with an affirmative unanimous result. The motion was declared passed.

Roy and Peggy Duenke

City Administrator Kuntz expressed appreciation to Roy and Peggy Duenke for their hard work on the Holiday Lighting Contest and serving as co-chairmen for the Ballwin 50th Anniversary, a year long series of events. He thanked them for their contribution to the community and making these events memorable.

Calendar

City Administrator Kuntz said the city calendars were supposed to be delivered to the residents the third week in December. A new vendor was used for this project. It closed down during the bad weather, thus delaying the calendar production and distribution. This vendor will not be used for the 2002 calendars. The calendars are at the Post Office and will hopefully be delivered this week.

New Ballwin Road Study

City Administrator Kuntz said the report from Crawford, Bunting, Brammeier is married to the concept of a continuous suicide lane. He didn’t think this was the type of roadway that the Board wanted for New Ballwin Road. Alderman Huddleston said when the roundabouts were discussed, it was suggested that the pedestrian crossings be moved away from the intersections, and this report is suggesting moving them to the intersections. Alderman Boland said some medians are recommended. Alderman Easter said she would like to see a drawing of the concept. Alderman Nichols said mid-block pedestrian signals would affect traffic flow considerably. People are still going to cross at the corners if there is a crosswalk there or not.

Alderman Buermann said the traffic on Saturday morning is backed up from Manchester Road to Holy Infant. Alderman Byatt said it’s hard for the kids to cross because the cars aren’t obeying the speed limit. The speed limit should not be raised.

Mayor Jones suggested that a representative of Crawford Bunting come before the Board after staff has relayed the concerns. Alderman Suozzi asked that Crawford, Bunting, Brammeier report to the Board regarding New Ballwin Road and the Kehrs Mill/Holloway Road intersection.

Annexation Area Zoning

City Administrator Kuntz said this is regarding the 1999 annexed areas and the need to place the zoning changes before the Planning and Zoning Commission for consideration and then the Board of Aldermen.

Assistant City Administrator Aiken explained that Ballwin needs to create a new district that is based on the St. Louis County R-4 District. This was done when the Ballwin R-2A and R-3 districts were created.

A motion was made by Alderman Huddleston and seconded by Alderman Buermann to place the zoning changes before the Planning and Zoning Commission for consideration and then the Board of Aldermen. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

Commercial Vehicles

City Administrator Kuntz said this is regarding a change to the definition of commercial vehicles to make it address types of vehicles that are not presently included.

Assistant City Administrator Aiken said this is recommended to include tow trucks, farm implements and other types of specialized vehicles and equipment.

A motion was made by Alderman Robinson and seconded by Alderman Nichols to have a draft amendment to the definition of commercial vehicles prepared for Board review. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

Construction Costs

City Administrator Kuntz said this is a recommendation that permit fees be tied to an industry cost of construction schedule rather than the estimates of the applicant. He said it would give a great degree of standardization and a positive revenue impact. Everyone would be treated alike.

A motion was made by Alderman Byatt and seconded by Alderman Huddleston to have an ordinance prepared for Board consideration and approval that the permit fees be tied to an industry cost schedule. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

Kehrs Mill / Holloway Intersection

City Administrator Kuntz said this is regarding the preliminary feasibility report for rebuilding the intersection. He said he would not recommend a double lane roundabout. Because of the Olde Towne Center, some traffic patterns in the future could change and there will be greater flexibility in manipulating a timing cycle with a 4-way activated signal, than trying to reconfigure lanes on a circle.

Alderman Byatt said if a signal is installed it should have a pedestrian phase. Alderman Suozzi said the design for New Ballwin Road is not pedestrian friendly. Alderman Robinson said it was made clear that the main concern for New Ballwin Road was pedestrian traffic. Alderman Nichols said the engineer’s design for New Ballwin Road has more concern for moving cars than being pedestrian friendly.

Alderman Robinson asked City Engineer Kramer if there’s any merit in staying with this engineering firm. Mr. Kramer said they are the best in St. Louis.

Closed Session

City Administrator Kuntz said at the conclusion of this meeting, a closed session is necessary to discuss a real estate acquisition issue.

ALDERMANIC COMMENTS

Alderman Nichols

A motion was made by Alderman Nichols and seconded by Alderman Suozzi that an ordinance be prepared for the January 22, 2001 agenda to put the ½ cent sales tax on the April ballot, in case the recommendation from the Citizen’s Committee is to do so. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

Alderman Easter

Alderman Nichols asked if this is being proposed for the petitions that are presently pending. Alderman Easter said the committee wants the city to install some of the conduit in those petitions that are pending. It is not proposed that the amended policy apply to anything pending, but only petitions that come before the Board as a new request. Those petitioners would have to secure the easements for the street lights. Alderman Nichols suggested an instruction document that covers these points be prepared to give to petitioners.

A motion was made by Alderman Easter and seconded by Alderman Robinson to change the street light policy and draft an ordinance. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

A motion was made

The Board of Aldermen reconvened into open session at 8:45 p.m. Mayor Jones announced that the Board voted unanimously while in closed session to allow Stewart Weissart to submit a real estate acquisition proposal for future consideration. Mayor Jones also announced that a motion had been made by Alderman Nichols and seconded by Alderman Buermann to adjourn into open session. A roll call vote was taken with a unanimous affirmative result and the closed session was adjourned at 8:43 p.m.

A motion was made by Alderman Nichols and seconded by Alderman Easter to adjourn. The motion passed unanimously and the open session adjourned at 8:47 p.m.

A roll call was taken with the following results: Ayes – Byatt, Easter, Suozzi, Buermann, Boland, Robinson, Huddleston, Nichols. Nays – None. Whereupon Mayor Jones declared the motion approved. The motion passed unanimously and the meeting was adjourned to closed session at 8:05 p.m.
said the Public Health & Safety Committee met before this meeting. There are petitions for 82 street lights still pending at a cost of about $5,000 per light. This is up from about $1,200 per light which was the cost prior to AmerenUE’s 1999 requirement for conduit. The Public Health & Safety Committee is prepared to ask the Board to change the official policy for street lights. It is recommended that a provision be added that makes the petitioners responsible for approaching the property owners to secure the easements. This is the problem with most of the 82 lights that are still pending. At this point, the committee is not recommending that the petitioner pay the cost of the conduit. In lieu of that, it is recommended that the City do a trial conduit installation on a few of the street lights now pending to see if the cost can be brought down.
said the Parks and Recreation Committee met with a group of concerned citizens about recommendations of the Parks and Recreation Committee of the Board of Aldermen. It was determined at the meeting that there was a great deal of concern about financing the implementation of the recommendations of the committee. They are going to meet again Thursday, January 11, at the Golf Club and will probably recommend that the Board place a ½ cent sales tax issue on the April, 2001 ballot. Their concern is the pool on Holloway Road and what needs to be done with that facility so it is a viable part of the Parks and Recreation services that it offers to the citizens. If this is going on the April ballot, January 23 is the deadline for certification to the Election Board. An ordinance would have to be passed on January 22.
: Mr. Goetz asked if anyone has done research on front wheel drive police cars. He has heard bad things regarding liability and safety. Police Chief Biederman said the front wheel drive cars have worked well in tests and on the streets. City Administrator Kuntz said of the six cars, only one will be front wheel drive. Chesterfield is going half and half on their fleet, and St. Louis County is into the second year with front wheel drive vehicles.
