The meeting was called to order by Mayor Pogue at 7:00 p.m.

MINUTES

The Minutes from the November 23, 2015 Board of Aldermen meeting and Closed Session meeting minutes were submitted for approval.

A motion was made by Alderman Fleming and seconded by Alderman Bullington to approve the November 23, 2015 Board Meeting minutes as submitted. A voice vote was taken with a unanimous affirmative result and the motion passed.

A motion was made by Alderman Fleming and seconded by Alderman Finley to approve the November 23, 2015 Closed Session meeting minutes as submitted. A voice vote was taken with a unanimous affirmative result and the motion passed.

A motion was made by Alderman Kerlagon and seconded by Alderman Bullington for a first reading of
Bill No. 3905. A voice vote was taken with a unanimous affirmative result and Bill No. 3905 was read for the first time

A motion was made by Alderman Roach and seconded by Alderman Stallmann for a second reading of
Bill No. 3905. A voice vote was taken with a unanimous affirmative result and Bill No. 3905 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3905 with the following results:

BILL NO. 3906 2015 OPERATING BUDGET AMENDMENT

A motion was made by Alderman Fleming and seconded by Alderman Bullington for a first reading of

BILL NO. 3907 2016 OPERATING BUDGET

A motion was made by Alderman Fleming and seconded by Alderman Leahy for a first reading of
Bill No. 3907. A voice vote was taken with a unanimous affirmative result and Bill No. 3907 was read for the first time

Alderman Finley asked Assistant City Administrator Tom Aiken about the expenditure from streetlights.

Assistant City Administrator Aiken explained the increase in the budget line item from 2015 is due to an expected rate increases to the electric company in 2016.

Alderman Finley also stated he reviewed the operating budget and capital budget and found everything was in order. He thought City Administrator Hanson, Finance Officer Keller and the Department Managers did a great job getting everything together. He has not heard any opposition or comment relative to the budget at the public hearing nor from any of his constituents.

Alderman Stallmann thanked City Administrator Hanson and Finance Officer Denise Keller for their work on the budget. He said this budget was one of the easiest budgets to comprehend. He agreed with Alderman Finley with his comment and applauds the staff’s work in preparing this document.

A motion was made by Alderman Finley and seconded by Alderman Roach for a second reading of
Bill No. 3907. A voice vote was taken with a unanimous affirmative result and Bill No. 3907 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3907 with the following results:
Ayes – Aldermen Finley, Stallmann, Terbrock, Roach, Fleming Kerlagon, Leahy, Bullington;
Nays -- None.

BILL NO. 3908 2016 CAPITAL BUDGET

A motion was made by Alderman Fleming and seconded by Alderman Bullington for a first reading of
Bill No. 3908. A voice vote was taken with a unanimous affirmative result and Bill No. 3908 was read for the first time

A motion was made by Alderman Kerlagon and seconded by Alderman Finley for a second reading of
Bill No. 3908. A voice vote was taken with a unanimous affirmative result and Bill No. 3908 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3908 with the following results:

CONSENT ITEMS
Budgeted items which are low bid and do not exceed expenditure estimates and/or
items which have been previously approved in concept.

a. LIQUOR LICENSE BALLWIN ATHLETIC ASSOCIATION

A motion was made by Alderman Terbrock and seconded by Alderman Bullington to deny the Consent Items. A voice vote was taken with a unanimous affirmative result and the motion passed. The liquor license was denied.

MAYOR’S REPORT

Mayor Pogue congratulated the Police Department for making Ballwin one of the top 25 safest cities in Missouri as reported from Safewise.

Mayor Pogue has nominated Tracy Bolte from Ward 4 to fill the vacancy in the Planning and Zoning Commission. Tracy has been a trustee for the Westglen Subdivision as well as being very active in Scouts.

Alderman Finley commented that he is familiar with Tracy Bolte and thinks he is an excellent choice.

A motion was made by Alderman Finley and seconded by Alderman Leahy to approve Mayor Pogue’s recommendation to approve Tracy Bolte to the Planning and Zoning Commission. A voice vote was taken with a unanimous affirmative result and the motion passed.

CITY ADMINISTRATOR’S REPORT

City Administrator Eric Hanson thanked the Finance Department for their hard work with putting the budget together. He especially thanked Denise Keller for her time and efforts with the budget, in particular, the reformatting of the budget which allows the City to apply for the distinguished budget and reporting award with the GFOA, which is an additional opportunity for recognition for financial reporting. He looks forward to starting the new calendar year and fiscal year in good order.

STAFF REPORTS

THE POINTE & NORTH POINTE SKYLIGHT PANEL REPLACEMENTS
Linda Bruer received bids for the replacement of the skylights at the Pointe and North Pointe. She recommended that the Board approve the second lowest bid from DHA. The lowest bid from Lexicon did not meet specifications. The low bidder, Lexicon, intended to replace the panels with material that did not meet OSHA load requirements.

A motion was made by Alderman Stallmann and seconded by Alderman Bullington to approve staff recommendation and award the contract to DHA. A voice vote was taken with a unanimous affirmative result and the motion passed.

CITY ATTORNEY’S REPORTS

USED VEHICLE PROPOSED LEGISLATION
City Attorney Jones stated he used legislation from the City of St. Peter’s as a template for creating this draft legislation. He added additional information based on the feedback from the last meeting.

The system requires prior Aldermanic authority be granted prior to purchase a piece of used equipment. The department head would first present their proposal to the City Administrator and Finance Officer prior to the matter being placed on the aldermanic agenda.

Alderman Fleming asked that the sentence sequence be rearranged to make the bill read clearer.

A motion was made by Alderman Leahy and seconded by Alderman Finley to have City Attorney Jones prepare legislation for the next Board meeting. A voice vote was taken with a unanimous affirmative result and the motion passed.

Mayor Pogue announced that Pursuant to Section 610.021 [13] RSMo & Section 610.021 [3] RSMo, the board will meet in closed session to discuss personnel and employee matters.

Adjourn to Closed Session: A motion was made by Alderman Bullington and seconded by Alderman Kerlagon to adjourn to closed session to discuss employee matters. A roll call vote was taken with the following results:

Ayes: Aldermen Terbrock, Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon
Nays: None

The motion passed to adjourn to closed session at 7:19 p.m.

The Board reconvened in open session at 7:47 p.m.

Reconvene in Open Session: A motion was made by Alderman Fleming and seconded by Alderman Leahy to reconvene in open session. A voice vote was taken with a unanimous affirmative result and the motion passed.

Mayor Pogue announced Ballwin’s Police Chief Steve Schicker would be retiring, effective December 16, 2015.

With the passing of the 2016 budget, Mayor Pogue recommended the Board make a motion to cancel the December 28, 2015 Board meeting.

A motion was made by Alderman Fleming and seconded by Alderman Finley to cancel the next Board meeting. A voice vote was taken with a unanimous affirmative result and the motion passed.

ALDERMANIC COMMENTS

Alderman Fleming asked if the City could look into the installation of banners on the new street light standards in the Manchester Rd. islands. He also wished everyone a happy holiday and thanked everyone for their hard work.

Alderman Terbrock also wished everyone a happy holiday. He stated his appreciation for the smooth transition with a new City Administrator and thanked Ms. Keller for her hard work on the budget.

Alderman Finley mentioned a fatal accident that occurred early that day involving a Ballwin resident. He said he drove by the scene and observed Captain Kevin Scott taking charge of the situation and thought he did a great job securing the scene of the accident and handling the situation. The rest of the officers, he observed, were also doing a great job preserving the accident scene, investigating and assisting the motorists. He also wished everyone a happy holiday.

Mayor Pogue commented that he thought the City did a great job communicating to the public about the closure of Manchester Road due to the accident.

Alderman Stallmann said he has noticed a stronger presence of Ballwin on social media and thinks that it is positive for the City. He also said this completes his first year in his aldermanic position. He wished everyone a Merry Christmas and a Happy New Year.

Alderman Kerlagon said she would not be running for re-election in April. She also wished everyone a happy holiday.

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting. A roll call vote was taken with a unanimous result, and the meeting was adjourned
at 7:52 p.m.
