MINUTES 

The Minutes of the May 9, 2016 Board of Aldermen meeting minutes were submitted for approval. 

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve the May 9, 2016Board of Aldermen meeting minutes as presented.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

The Minutes of the May 16, 2016 Board of Aldermen Planning Session meeting minutes were submitted for approval. 

A motion was made by Alderman Fleming and seconded by Alderman Finley to approve the May 16, 2016Board of Aldermen Planning Session meeting minutes as presented.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

PRESENTATION 

The Ballwin Police Department 2015 overview was presented by Chief Kevin Scott.

 

CITIZEN COMMENTS

Bill Bantel, 144 Vlasis Dr., is Commander of the Ballwin VFW. He asked that the Board consider improving the Veterans Memorial to accommodate larger crowds at ceremonies.

 

NEW BUSINESS

LEGISLATION       Next Ordinance # 16-19

 

BILL NO. 3929 SALES TAX HOLIDAY

There was no reading of Bill No. 3929. It was the consensus of the Board that the City will continue to participate in the Sales Tax Holiday.

 

BILL NO. 3930 COLLECTION BINS

A motion was made by Alderman Fleming and seconded by Alderman Leahy for a first reading of
Bill No. 3930.  A voice vote was taken with a unanimous affirmative result and Bill No. 3930 was read for the first time

City Attorney Jones stated that a for-profit company called Usagain contacted the City about placing drop off bins on commercial properties. Currently there are no regulations for the placement or thesupervision of such donation bins. This ordinance would regulate these bins to make sure of proper maintenance and would allow both for-profit and non-profit companies/organizations.

The Board further discussed the content of the legislation and recommended there be changes to further clarify certain issues within this ordinance. City Attorney Jones will provide the changes at the next Board meeting.

 

BILL NO. 3931 LIQUOR LICENSE AMENDMENT

A motion was made by Alderman Fleming and seconded by Alderman Leahy for a first reading of
Bill No. 3931.  A voice vote was taken with a unanimous affirmative result and Bill No. 3931 was read for the first time

City Attorney Jones stated that this ordinance amendment would extend the City’s ability to limit issuance and allow the City to suspend a liquor license. 

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon for a second reading of
Bill No. 3931.  A voice vote was taken with a unanimous affirmative result and Bill No. 3931 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3931 with the following results: 

Ayes – Aldermen Fleming, Kerlagon, Stallmann, Finley, Roach, Bullington, Leahy;
Nays -- None. 
Bill No. 3931 was approved and became Ordinance No. 16-19

At the request of Alderman Fleming, consent item “e” was held for further discussion.

A motion was made by Alderman Fleming and seconded by Alderman Leahy to accept Consent Items A thru D.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

MAYOR’S REPORT 

Mayor Pogue recommended the reappointment of Frank Hafner as an alternate and Bob Komor as a sitting member of the Board of Adjustment.

A motion was made by Alderman Fleming and seconded by Alderman Leahy to accept the reappointments of Frank Hafner and Bob Komor to the Board of Adjustment.  A voice vote was taken with a unanimous affirmative result and the motion passed. 

Mayor Pogue thanked the Ballwin Days Committee and City Staff who helped put on the Ballwin Days Festival.

Mayor Pogue announced Ballwin was listed at number seven in the top ten suburbs of St. Louis by a marketing and promotion website known as Homesnacks. The article was published in the Post-Dispatch.

 

CITY ADMINISTRATOR’S REPORT

Consent Item E: Alderman Fleming asked if the other companies didn’t meet bid specifications because this company still had the patent on this type of micro-surfacing? Public Works Director Gary Kramer stated that was correct.

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to accept consent item E.  A voice vote was taken with a unanimous affirmative result and the motion passed.

City Administrator Hanson congratulated Finance Officer Denise Keller and her staff for receiving the Distinguished Budget Award for 2016.

City Administrator also thanked Chief Kevin Scott for his presentation, which was well done.

 

ALDERMANIC COMMENTS

Alderman Bullington –  Recognized Jim Lieber, Darryl Holman, George Vitela , Pat McDermot, Liz Oglesby, Linda Bruer, and Chief Kevin Scott for another successful Ballwin Days. The weather was on the warm side and it made the crowds a little bit smaller, but those that came out certainly enjoyed themselves.  He thanked Mayor Pogue for putting together the parade float which showed that the Board is thoroughly involved in promoting the community.

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to adjourn the Board of Aldermen Meeting.  A roll call vote was taken with a unanimous result, and the meeting was adjourned at 8:15 p.m.

MINUTES

 

The Minutes of the June 13, 2016 Board of Aldermen meeting minutes were submitted for approval. 

A motion was made by Alderman Fleming and seconded by Alderman Leahy to approve the June 13, 2016Board of Aldermen meeting minutes to include the spelling correction of George Vitela and Liz Oglesby.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

 

 

 

CITIZEN COMMENTS

 

Rick Stream, of 1229 Lockett Ln in Kirkwood, Missouri, addressed the Board to thank them and the City of Ballwin for allowing him to participate in the Ballwin Days Parade. He said it was a lot of fun and that he met a number of people. He reiterated that he is running for State Senate, he added, he would provide each Board member with his personal cell phone number and email address.

 

Allison Miller of 652 Osage Ridge Rd in Augusta, Missouri, voiced her concern about the congested parking lot Andy’s Frozen Custard is causing and the effect it is having on her business, Copper Tan.

Ms. Miller said the loss of business may cause her to close her business. She stated Atlas Chiropractor will be relocating due to the parking lot issues.

Mayor Pogue said the City will see as to what can be done but she will ultimately need to have this discussion with her landlord.

 

 

OLD BUSINESS

 

 

BILL NO. 3930COLLECTION BINS

 

The issue of regulating collection bins can be done through the site plan ordinance. City Administrator Hanson said no further action was needed and did not recommend further action by the Board.

 

A motion was made by Alderman Roach and seconded by Alderman Fleming to table Bill No. 3930.  A voice vote was taken with a unanimous affirmative result and Bill No. 3930 was tabled.

MAYOR’S REPORT

 

Mayor Pogue informed those who were interested that the Missouri Municipal League Annual Conference will be held in St. Louis on September 11th thru 14th. Those who are interested in attending should let himself or City Administrator Hanson know.

 

Mayor Pogue stated that Ballwin has been recognized by Credit Donkey, a home security and credit website, for being named second safest city in the state of Missouri. He thanked Chief Scott for keeping the City safe.

 

Mayor Pogue also announced that the Post-Dispatch recognized the City of Ballwin as one of the best places to work. Ballwin was the only municipality to make the list as top workplaces. He thanked all the department heads and staff.

 

 

 

 

CITY ADMINISTRATOR’S REPORT

 

 

Consent Item B: City Administrator Hanson explained that this is a very active time for concrete contractors. One of the reasons the bids came back so high was because the project wasn’t large enough to warrant moving crews off other projects in order to get this project done.

Alderman Fleming asked if the City were to pursue purchasing a swap loader truck, if this would allow the City to install the ramps.

Director of Public Works stated that it would take our guys too long to complete the ramps. The reason for bidding it was because there was federal grant money coming through the community development block grant office that would help off-set the cost. It was suggested that staff pool the ramp replacement project with other concrete projects.

 

A motion was made by Alderman Stallmann and seconded by Alderman Roach to accept Consent Item B.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

 

 

 

CITY ATTORNEY’S REPORTS

 

 

USAGE OF THE CITY’S RIGHTS-OF-WAY

City Attorney Jones provided the board with revisions from a bill he prepared previously for use of the City’s Rights-of-way.

 

A motion was made by Alderman Fleming and seconded by Alderman Roach to have City Attorney Jones draft legislation.  A voice vote was taken with a unanimous affirmative result and the motion passed.

 

 

 

ALDERMANIC COMMENTS

 

Alderman Stallmann thanked staff for their continued work on social media, it is great to show the City’s involvement with the community.

 

Alderman Roach thanked the employees who have been working outside in the hot weather and that he appreciates all their hard work.

 

 

 

A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to adjourn the Board of Aldermen Meeting.  A roll call vote was taken with a unanimous result, and the meeting was adjourned
