MINUTES OF THE BOARD OF ALDERMEN MEETING
CITY OF BALLWIN – 300 PARK DRIVEBLIC UTILITY USE, FOR THE PURPOSE OF TRANSMITTING, FURNISHING AND DISTRIBUTING ELECTRICITY FOR LIGHT, HEAT, POWER AND OTHER PURPOSES WITHIN AND THROUGH SAID CITY, PRESCRIBING THE TERMS AND CONDITIONS OF SUCH GRANT, IMPOSING CERTAIN OBLIGATIONS UPON THE GRANTEE, ITS SUCCESSORS AND ASSIGNS, SUCCESSIVELY, IN CONNECTION THEREWITH.

MINUTES APPROVAL

The Minutes of the August 27, 2001 Board of Aldermen meeting were submitted for approval. A motion was made by Alderman Nichols and seconded by Alderman Easter to approve the Minutes. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

A motion was made by Alderman Boland and seconded by Alderman Easter for a first reading of Bill No. 3115. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3115 was read for the first time.

A motion was made by Alderman Nichols and seconded by Alderman Suozzi for a second reading of Bill No. 3115. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3115 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3115 with the following results: Ayes – Suozzi, Boland, Robinson, Gatton, Easter, Nichols . Nays – None. Whereupon Mayor Jones declared Bill No. 3115 approved and it became Ordinance No. 01-56.

BILL # 3116

- AN ORDINANCE AMENDING THE WARD BOUNDARIES OF THE CITY OF BALLWIN TO ADJUST SUCH WARD BOUNDARIES IN ACCORDANCE WITH THE YEAR 2000 CENSUS.

A motion was made by Alderman Robinson and seconded by Alderman Nichols for a first reading of Bill No. 3116. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3116 was read for the first time.

A motion was made by Alderman Suozzi and seconded by Alderman Easter for a second reading of Bill No. 3116. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3116 was read for the second time.

Alderman Robinson requested letters be sent from the Aldermen to the residents being affected by the ward change. City Administrator Kuntz said the new Election Board printout will contain the address and ward information.

A roll call was taken for passage and approval of Bill No. 3116 with the following results: Ayes – Nichols, Gatton, Robinson, Suozzi, Easter, Boland. Nays – None. Whereupon Mayor Jones declared Bill No. 3116 approved and it became Ordinance No. 01-57.

BILL # 3117

- AN ORDINANCE ORDERING THE INSTALLATION BY ST. LOUIS COUNTY WATER COMPANY OF ONE (1) FIRE HYDRANT AT SPRING COVE SUBDIVISION.

A motion was made by Alderman Nichols and seconded by Alderman Easter for a first reading of Bill No. 3117. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3117 was read for the first time.

A motion was made by Alderman Robinson and seconded by Alderman Gatton to change "St. Louis County Water Company" to the new name, "Missouri American Water Company". A voice vote was taken with an affirmative result and the motion was declared passed.

A motion was made by Alderman Suozzi and seconded by Alderman Gatton for a second reading of Bill No. 3117, as amended. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3117 was read for the second time.

A roll call was taken for passage and approval of Bill No. 3117 with the following results: Ayes – Gatton, Easter, Nichols, Boland, Suozzi, Robinson. Nays – None. Whereupon Mayor Jones declared Bill No. 3117 approved and it became Ordinance No. 01-58.

- AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN BY AMENDING SEC. 15-114 (A) REGARDING THE BLOOD ALCOHOL LEVEL TO REFLECT THE REVISED STATE STANDARD.

A motion was made by Alderman Gatton and seconded by Alderman Easter for a first reading of Bill No. 3118. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3118 was read for the first time.

A motion was made by Alderman Robinson and seconded by Alderman Suozzi for a second reading of Bill No. 3118. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3118 was read for the second time.

- AN ORDINANCE AMENDING CHAPTER 15, SEC. 15-73, ENTITLED "OBSTRUCTIONS TO VISION OF DRIVER; TINTED GLASS, ETC.," OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN, BY DELETING THE PRESENT SEC. 15-73 AND INSERTING THEREFORE A REVISED PARAGRAPH DEALING WITH SIMILAR SUBJECT MATTER.

A motion was made by Alderman Easter and seconded by Alderman Nichols for a first reading of Bill No. 3119. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Bill No. 3119 was read for the first time.

by Alderman Nichols and seconded by Alderman Easter to adjourn. The motion passed unanimously and the meeting was adjourned at 7:48 p.m. Alderman Nichols said he has submitted his resignation from the Board of Aldermen, effective October 1, 2001. He said he is retiring from his job and from the Board of Aldermen after almost 20 years. He has enjoyed serving the City of Ballwin. by Mayor Jones and seconded by Alderman Robinson to prepare a bill for Aldermanic review, per Public Health & Safety Committee recommendations, prohibiting certain vehicles from traveling on the sidewalks, to include motorized vehicles, toys and other self-propelled apparatuses. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. Alderman Easter reported that this meeting was held at 6:30 p.m. on this date. A motion was made by Alderman Robinson and seconded by Alderman Boland to cancel the September 24 Board of Aldermen meeting due to a lack of agenda items. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. A motion was made by Alderman Easter and seconded by Alderman Boland to pre-authorize a contract with the lowest qualified bidder on the Ries Ct. sewer project after the bids are opened. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. City Administrator Kuntz said Director of Parks and Recreation Bruer has requested the pool be closed as of August 10 for construction. The project would be completed around Memorial Day. Mayor Jones suggested deferring this decision until the October 8 meeting. City Administrator Kuntz said the Ballwin calendar deadline has been moved up due to printing and delivery problems in the past. City Administrator Kuntz said this is regarding Ries Road. There is a cost factor in excess of $75,000 more than the bid. He said this was a situation where a major element of the work was not included in the engineer’s calculation. The Board authorized drafting a letter stating the City’s position on the consultant responsibility for the disputed quantities. by Alderman Nichols and seconded by Alderman Boland to draft legislation to upgrade the non-police LAGERS pension plan to the next level. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. City Administrator Kuntz said this is regarding the pension plan for all non-police employees. The City is currently at Level 3 and has been since 1978. The next level up is Level 7. There is an opportunity, at little additional budget cost, to improve our pension plan, subject to budget appropriations. The upgrade to the next level would be about $40,000 over the 2001 budget appropriation. He said he wants to keep parity with the police plan. The change would be effective on January 1, 2002. by Alderman Easter and seconded by Alderman Nichols to draft legislation for aldermanic review. A voice vote was taken with a unnimous affirmative result and the motion was declared passed. City Administrator Kuntz said this is regarding the administrative authority to stop work on construction projects for a variety of issues. by Alderman Nichols and seconded by Alderman Suozzi to draft legislation to implement the fees. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. City Administrator Kuntz said this is regarding the addition of two fees, $7.50 for Crime Victims Compensation Fund, and $25.00 for the Spinal Cord Injury Fund. The $25.00 fee would be collected on all cases involving persons who have been convicted on an intoxication-related offense. Legislation will be required for passage. by Alderman Nichols and seconded by Alderman Gatton to accept the donation and write a thank you letter for the donation. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. City Administrator Kuntz reported that the Dean Automotive Group would like to donate a 1991 Ford Mustang Convertible for use in the D.A.R.E. program.Mayor Jones stated that there are no items for this report.Mayor Jones stated that there are no consent items.

 

BILL # 3115

- AN ORDINANCE ACCEPTING THE STREETS OF CASTLE PINES SUBDIVISION PLATS 1-A, 1-B, 2, 3, 6, 7, 10, 12 AND THE ESTATES AT CASTLE PINES FOR PUBLIC MAINTENANCE AS PROVIDED FOR IN THE CODE OF ORDINANCES OF THE CITY OF BALLWIN.: She requested a time frame for the street improvements. City Administrator Kuntz said the analysis is being made at this time and a priority list is being prepared. The report should be available in October and will be used to guide the budget expenditures for 2002.: Representing the Danbury Subdivision residents, she presented a petition regarding the poor condition of the streets in the subdivision.
