The meeting was called to order by Mayor Pogue at 7:00 p.m.

MINUTES

The Minutes of the August 28, 2017 Board of Aldermen meeting minutes were submitted for approval. 
 
Alderman Finley asked to amend the minutes in the first motion of the approval of the August 28, 2017, minutes to show it was Alderman Roach who made the first motion.
A motion was made by Alderman Finley and seconded by Alderman Fleming to amend the first motion made by Alderman Finley for the approval of the minutes to Alderman Roach who made the first motion.

A motion was made
by Alderman Fleming and seconded by Alderman Terbrock to approve the amended August 28, 2017 Board of Aldermen meeting minutes as presented.  A voice vote was taken with a unanimous affirmative result and the motion passed.

The Minutes of the August 28, 2017 Board of Aldermen Closed Session meeting minutes were submitted for approval. 
A motion was made by Alderman Fleming and seconded by Alderman Terbrock to approve the August 28, 2017 Closed Session meeting minutes as presented.  A voice vote was taken with a unanimous affirmative result and the motion passed.


PRESENTATION

City Hall Presentation – City Administrator Hanson stated the design team from Chiodini was present to provide an update on the progress that has been made in the planning of the design for City Hall.


CITIZEN COMMENTS

John Milla, 307 Ridge Oak Court, wanted to provide the Board with some of his comments. He said the 2017 budget presentation was very well put together and he understands why the department received the award. He stated the City, in general, does a great job. Mr. Milla also added that the Castle Law presentation was great. He’s a big supporter of the Ballwin Police Department. He would like the Board to give the Police Department the best. He received a letter from Shamed Dogan about a town hall. Mr. Milla stated Mr. Dogan would be talking about crime prevention and he feels like that police department should be the ones in charge of crime prevention, not a representative. He closed his comments by stating he and his wife have been residents of Ballwin for over 25 years and they don’t plan to move.


OLD BUSINESS

LEGISLATION

BILL NO. 3970 Sign Ordinance

A motion was made by Alderman Fleming and seconded by Alderman Finley for a first reading of
Bill No. 3970.  A voice vote was taken with a unanimous affirmative result and Bill No. 3970 was read for the first time

Alderman Roach asked about Schedule E in regards to the intersection of Old Ballwin Road and Nancy Place. He asked if it should read ‘Nancy place at Old Ballwin and Stop Traffic on Nancy Place.’ City Attorney Jones stated that is correct.

A motion was made by Alderman Roach and seconded by Alderman Fleming to amend Schedule E to read Nancy place at Old Ballwin and Stop Traffic on Nancy Place. A voice vote was taken with a unanimous affirmative result.

City Administrator Hanson stated Clayton Corners Subdivision HOA provided signed petition from all the residents providing recommendations for parking issues to include additional signage for no parking areas.

City Attorney stated there was an additional change made to Woodside Trails’ signage.

A motion was made by Alderman Fleming and seconded by Alderman Terbrock for a second reading of Bill No. 3970.  A voice vote was taken with a unanimous affirmative result and Bill No. 3970 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3970 with the following results:  Ayes – Aldermen Fleming, Terbrock, Roach, Bullington, Finley, Stallmann, Kerlagon, Leahy;
Nays -- None. 
Bill No. 3970 was approved and became Ordinance No. 17-23

NEW BUSINESS

BILL NO. 3972 Subdivision Plat Approval for Property Located at 225 Reinke

A motion was made by Alderman Fleming and seconded by Alderman Bullington for a first reading of
Bill No. 3972.  A voice vote was taken with a unanimous affirmative result and Bill No. 3972 was read for the first time

A motion was made by Alderman Fleming and seconded by Alderman Bullington for a second reading of Bill No. 3972.  A voice vote was taken with a unanimous affirmative result and Bill No. 3972 was read a second time.

A roll call vote was taken for passage and approval of Bill No. 3972 with the following results: 

Ayes – Aldermen Fleming, Terbrock, Finley, Leahy, Roach, Kerlagon, Bullington, Stallmann
Nays -- None. 
Bill No. 3972 was approved and became Ordinance No. 17-24

Resolution Early Retiree Healthcare Initiative
A motion was made by Alderman Fleming and seconded by Alderman Terbrock to pass the Resolution.  A voice vote was taken with a unanimous affirmative result and the resolution passed.

MAYOR’S REPORT

Mayor Pogue announced that it was Finance Officer Denise Keller’s Birthday and asked that the Board sing Happy Birthday to Ms. Keller. 

CITY ADMINISTRATOR’S REPORT

2018 Budget Discussion – City Administrator Hanson provided an updated schedule to the Board for the Budget Calendar. He stated there will be a budget workshop prior to the Board meeting on September 26. There will be tentative work sessions scheduled for October.
City Administrator Hanson thanked Kirsten Hochstetler for filling in for the City Clerk while she is at the MML conference working on her Clerk Certifications.

CITY ATTORNEY’S REPORT

Bee Ordinance – City Attorney Jones presented the draft bee ordinance he had prepared for the Board. Based on previous discussions, there is no permitting process or restriction. This ordinance gives guidance should a complaint or dispute arise.

Alderman Roach asked if the individuals who were present at the board meeting and provided feedback have been contacted and presented with this proposed ordinance.

Mayor Pogue asked that staff reach out to the individuals who provided feedback on the beekeeping ordinance and that they be provided a copy of the proposed legislation.

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to direct City Attorney to bring back the draft beekeeping ordinance as legislation.  A voice vote was taken with a unanimous affirmative result and the motion passed.

Mayor Pogue announced pursuant to state statute 610.021 (13) RSMo he would like go into closed session to discuss personnel issues.

A motion was made by Alderman Stallmann and seconded by Alderman Fleming to adjourn the open session meeting.  A roll call vote was taken with a unanimous result, and the open session meeting was adjourned at 8:00 p.m.

A motion was made by Alderman Terbrock and seconded by Alderman Kerlagon to reconvene in Open Session.  A voice vote was taken with a unanimous result, and the open session meeting reconvened at 10:10 p.m.

A motion was made by Alderman Fleming and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting.  A voice vote was taken with a unanimous result, and the meeting was adjourned
 at 10:10 p.m.
