Jet’s Pizza has operated as a restaurant at 14940 Manchester Road since February of 2013. The CAP Plaza in which Jet’s is located operates under an approved site development plan pursuant to a Manchester Road Revitalization Overlay District approval via Ordinance 11-16 in 2011. The restaurant operates without any zoning review or approval pursuant to Ordinance 11-16 because restaurants were included as an allowed use under that ordinance. The sale of alcohol by the drink, however, does not have this same provision. Such sales must be approved through the SUE process.

The meeting of the Planning and Zoning Commission was called to order by Chairman Michael Wind at 7:02 p.m. Members in attendance were:

Approval of Minutes

A motion was made by Commissioner Karr and seconded by Secretary Weaver to approve the minutes of the May 4, 2015 meeting of the Planning & Zoning Commission as submitted. The motion received unani-mous approval from the Commission members present.

Election of Officers
Mayor Pogue nominated Michael Wind to continue as Chairman of the Planning & Zoning Commission. Mr. Wind accepted the nomination, which was seconded by Commissioner Utt and received unanimous approval from the Commission members present. Chairman Wind nominated Mark Weaver to continue as Secretary of the Planning & Zoning Commission. Mr. Weaver accepted the nomination, which was se-conded by Commissioner Utt and received unanimous approval from the Commission members present.

SUE 15-01 Special Use Exception

Ms. Lorene Samson was present to answer any questions regarding the petition. Chairman Wind stated his concern about the proximity of the Ballwin Athletic Association baseball fields and wanted confirmation that the employees will be properly trained not to serve minors, and that consumption is to be on the prem-ises only. Ms. Samson said under Missouri state law, with a “by the drink” liquor license, Jet’s Pizza would have the right to sell alcohol by the package, although they have no plans to do so. She added that the em-ployees will be trained to not serve minors.

Chairman Wind opened the public hearing, and asked if anyone wished to speak in opposition to Petition SUE 15-01. No one came forward. Chairman Wind asked if anyone wished to speak in favor of the peti-tion. No one came forward, and Chairman Wind closed the public hearing.
Mayor Pogue made a motion to recommend approval of Petition SUE 15-01 to the Board of Aldermen. Commissioner Utt seconded the motion, which received unanimous approval from the commission members present.

Z 15-06 Zoning Ordinance Change (Final PSD Development Plan Approval)

Mr. Scott Paul of Vanderbilt Homes was present to answer any questions about the petition. Mayor Pogue asked City Planner Aiken if there are any changes from the last submittal. Mr. Aiken said there is nothing that is substantively different, so he doesn’t have any recommendations.

Chairman Wind opened the public hearing, and asked if anyone wished to speak in opposition to Petition Z 15-06. No one came forward. Chairman Wind asked if anyone wished to speak in favor of the petition. No one came forward, and Chairman Wind closed the public hearing.

Chairman Wind made a motion to recommend approval of Petition Z 15-06 to the Board of Aldermen. Commissioner Goetz seconded the motion, which received unanimous approval from the commission members present.

Other Business

Chairman Wind asked City Planner Aiken if there are items for the July agenda. Mr. Aiken said there is one item, and asked if everyone will be available, since it is the end of the Independence Day weekend. Commissioner Utt and Mayor Pogue said they will not be able to attend on July 6. Mayor Pogue suggested moving the meeting to July 13, since the Board of Aldermen is on a summer schedule. Mr. Aiken said if the Commission members are all available for that date, he will notify the petitioner of the change. It was decided to change the date of the meeting to July 13. City Planner Aiken said that since the public hearing has already been advertised for a July 6 meeting, he will attend and post a notice that the meeting has been postponed.

Adjournment

Chairman Wind moved to adjourn the meeting. Secretary Weaver seconded the motion, which received unanimous approval from the commission members present. The meeting was adjourned at 7:14 p.m.
